Below, we describe the terms and conditions applicable to a booking and stay with Serana, as well as the terms and conditions applicable to the use of our website.When we use the term “Site,” we are referring to our www.seranatx.com website, together with any affiliated mobile applications, as well as to any content, functionality, and services offered on or through this website and/or any affiliated mobile applications or websites (like Airbnb). The Site is owned and operated by Serana LLC. (who we refer to, together with our affiliates, as “Serana,” “us,” “we,” or “our,” depending on the context). When we refer to “you” and “your” in these terms, we are referring to you as a visitor to and user of the Site and, as applicable, to you as a visitor to on of our Serana property.
YOU SHOULD CAREFULLY READ THESE TERMS. By accessing, browsing, or otherwise using the Site, you are creating a binding contract between you and us, and you are acknowledging that you have read, understood, and agreed to be bound by these terms.We may make changes to the Site or these terms at any time. Any modifications will be effective when the changes are posted to the Site. You can review the most current version of these terms at any time by accessing the section of the Site labeled [Terms], and you can determine when this Privacy Policy was last revised by referring to the “Last Updated” legend at the top of these terms. You are expected to check these terms from time to time to take notice of any changes. You understand and agree that your continued access to or use of the Site after any posted modification to these terms indicates your acceptance of the modification, even if you did not take the time to read the modification.
Serana LLC is located on a very rural, mostly undeveloped plot of land in Central Texas. Guests are completely responsible for their own safety and for having basic wilderness survival skills (e.g. do not approach wild animals, do not leave food out, etc.). Serana LLC is not liable for bodily injury (including death) or damage to personal property, including vehicles, due to exposure to inclement weather or rural, rugged settings. By booking at Serana LLC (through www.seranatx.com or the Serana Airbnb), guests recognize and accept this responsibility and affirm they have these general skills. In addition, while people enjoy Serana for its secluded setting, our Kampinas, glamping tents, and common facilities are shared by all guests. Although we do our best to keep all facilities safe and clean, including enhanced cleaning procedures to address COVID-19, Serana LLC is not liable for illness that may result in whole or in part from the use of our facilities. Guests are expected to observe prevailing CDC recommendations during their stay (including social distancing) and take other appropriate steps to maintain their health. By booking at Serana, guests recognize and accept that responsibility for their physical health and informing themselves of such protocols is fully their own.
Serana LLC lists their Kampinas, glamping tents, and BYOtent options on Airbnb. When booking through Airbnb, all terms and conditions listed on this page still apply to a guest visiting Serana.
Please note that by looking at this "Site" (through www.seranatx.com or a Serana listing on Airbnb.com) and accepting these terms, guests agree that they are liable for any damages caused by themselves or their accompanying party.
By booking with Serana LLC or any site associated with Serana LLC (including but not limited to Airbnb.com), guests understand there is significant risk of serious physical injury inherent in rural Texas (including but not limited to wild animals, snakes, potholes, fire ants). Guests also understand the inherent risk that could result from any activity undertaken at Serana, including but not limited to: weightlifting, yoga, hiking, sitting in the sauna, or any other activity not specifically listed. These risks include but are not limited to: failure of flooring system, failure of equipment; defective, torn, or separated flooring; strained or sprained muscles; broken bones; dehydration; burn; personal injury, including paralysis, death, illness, property damage, and other losses. Injuries or death can arise from errors of judgement, lack of training or experience, from the negligence of guests, Serana, and its employees or owners or other parties. Guests understand that such risks cannot be reduced without jeopardizing the essential qualities of the activity. Guests certify that they understand that being outdoors and all physical activity undetaken at Serana, expose the guest to a high risk of injury or accident. Guests knowingly and voluntarily assume and accept all risks, whether known or unknown, of injury, illness, death, or damage of whatever kind arising out of guests stay at Serana.
You hereby indemnify, defend, and hold Serana and its affiliates, owners, parents, partners, subsidiaries, franchisees, officers, directors, contractors, subcontractors, attorneys, guests and employees (collectively, “the Indemnified Parties”) harmless from and against any and all allegations, demands, claims, liabilities, damages, fines, penalties, liens, expenses or costs whatsoever (including attorneys fees) for any loss which arise out of (i) this Agreement, (ii) this site or the content contained herein, (iii) third party sites, (iv) communications, or (v) transactions or activity relating to this site. By using this site, you and (if applicable) each of your respective officers, employees, directors, shareholders, parents, subsidiaries, alter egos, affiliates, partners, agents, attorneys, accountants, heirs, executors, administrators, conservators, trustees, successors and assigns hereby fully and forever release and discharge the Indemnified Parties from any and all Claims, whether or not caused by the negligence of any of the Indemnified Parties whether now known or suspected.The foregoing does not affect Serana's liability for death or personal injury arising from our gross negligence, nor our liability for fraudulent misrepresentation, nor any other liability which cannot be excluded or limited under applicable law.
All guests staying in the cabin must be 21 years of age or older, unless accompanied by a parent or legal guardian. Guests are required to use a credit card in their own name in order to book a cabin. No illegal substances are permitted on the Serana property.
Weapons of any kind are not allowed on Serana property. This includes, but is not limited to: standard firearms, air guns, deterrent devices such as tasers or pepper spray, ammunition of any kind, and imitation firearms.
Smoking, including the use of e-cigarettes, is not permitted inside the cabins and must be done at a minimum distance of 25 feet from all buildings. Litter is not permitted on the land and guests must clean up all cigarette butts. Guest will be fined a fee of $150 for each night that the cabin is unable to be occupied after stay if said guest is found smoking within the cabin.
Serana is on a plot of land where wildlife may be present. When booking at Serana, the guest agrees to take appropriate safety measures to prevent negative interactions with wildlife in the area. This includes, but is not limited to, not engaging with wild animals, keeping food out of reach, keeping the site clean, and securing all personal items. Fire ants, mosquitos, and other insects may also be present at the site – all guests are expected to take necessary steps of precaution against these insects. Guests are also not permitted to harm the land or the natural habitat of any wildlife in any way. Serana is not liable for any personal injury due to wildlife or insects.

Serana shall not be responsible for any direct or indirect damages caused to our land as consequence of use. This includes damages, insurance, loss due to fire, theft, and misconduct.In the event that a guest fails to comply with any terms applicable to their booking and/or stay, Serana reserves the right to ask the guest to leave the unit and property, and the guest in question shall not be entitled to any form of compensation. Upon booking any property with Serana guests automatically accept our terms, which we expect them to comply with.
YOU ACKNOWLEDGE, AGREE AND UNDERSTAND THAT: WE ATTEMPT TO DISPLAY THE MATERIALS AND INFORMATION YOU VIEW ON THE SITE AS ACCURATELY AS POSSIBLE. HOWEVER, WE DO NOT GUARANTEE THE ACCURACY OF SUCH MATERIALS AND INFORMATION, AND ARE NOT RESPONSIBLE FOR ANY CLAIMS ARISING OR RESULTING FROM YOUR RELIANCE THEREON.THE SITE AND ALL INFORMATION, CONTENT, MATERIALS, PRODUCTS AND SERVICES INCLUDED ON OR OTHERWISE MADE AVAILABLE THROUGH THE SITE ARE PROVIDED ON AN “AS IS” AND “WHERE AVAILABLE” BASIS AND WITHOUT WARRANTIES OF ANY KIND. TO THE FULLEST EXTENT PERMITTED BY LAW, WE DISCLAIM ALL WARRANTIES, EXPRESS OR IMPLIED, INCLUDING IMPLIED WARRANTIES OF MERCHANTABILITY AND FITNESS FOR A PARTICULAR PURPOSE AND NON-INFRINGEMENT.WE DO NOT REPRESENT OR WARRANT THAT THE SITE WILL BE UNINTERRUPTED OR ERROR-FREE, THAT ANY DEFECTS WILL BE CORRECTED, OR THAT THE SITE, INFORMATION, CONTENT, MATERIALS, PRODUCTS OR SERVICES INCLUDED ON OR OTHERWISE MADE AVAILABLE THROUGH THE SITE, THE SERVERS THAT MAKE THE SITE AVAILABLE, OR E-MAIL OR OTHER CORRESPONDENCE SENT THROUGH THE SITE, ARE OR WILL BE FREE OF VIRUSES OR ANYTHING ELSE HARMFUL. WE DO NOT MAKE ANY WARRANTIES OR REPRESENTATIONS REGARDING THE USE OF ANY INFORMATION, CONTENT, MATERIALS, PRODUCTS AND SERVICES INCLUDED ON OR OTHERWISE MADE AVAILABLE THROUGH THIS SITE IN TERMS OF THEIR CORRECTNESS, ACCURACY, ADEQUACY, USEFULNESS, RELIABILITY OR OTHERWISE.CERTAIN STATE LAWS MAY NOT ALLOW LIMITATIONS OR EXCLUSIONS ON WARRANTIES, SO THE ABOVE LIMITATIONS MAY NOT APPLY TO YOU.
WE WILL NOT BE LIABLE FOR ANY DAMAGES OR INJURY CAUSED BY YOUR USE OF THE SITE, INCLUDING ANY FAILURE OF PERFORMANCE, ERROR, OMISSION, INTERRUPTION, DEFECT, DELAY IN OPERATION OF TRANSMISSION, COMPUTER VIRUS, OR LINE FAILURE. WE WILL NOT BE LIABLE FOR ANY DAMAGES OR INJURY, INCLUDING INDIRECT, INCIDENTAL, SPECIAL, PUNITIVE, EXEMPLARY OR CONSEQUENTIAL DAMAGES (INCLUDING LOST PROFITS AND DAMAGES THAT RESULT FROM INCONVENIENCE, DELAY, OR LOSS OF USE) THAT RESULT FROM THE USE OF, THE INABILITY TO USE, OR RELIANCE UPON, THE SITE OR ANY SERVICES OBTAINED ON OR THROUGH THE SITE OR ANY SITE WE OFFER OUR SERVICES THROUGH (AIRBNB), EVEN IF THERE IS NEGLIGENCE BY US OR BY OUR AUTHORIZED REPRESENTATIVE, OR WE HAVE BEEN ADVISED OF THE POSSIBILITY OF SUCH DAMAGES, OR ANY OF THE ABOVE. THE ABOVE LIMITATION OR EXCLUSION MAY NOT APPLY TO YOU TO THE EXTENT THAT APPLICABLE LAW MAY NOT ALLOW THE LIMITATION OR EXCLUSION OF LIABILITY FOR SUCH DAMAGES.
